TEMPO.CO, Jakarta - The Bandung District Court declared on Monday that the naming of Pegi Setiawan as a suspect in the eight-year-old murder case of Muhammad Rizky Rudiana and Vina Dewi Arsita was legally invalid.
Judge Eman Sulaeman said in his verdict that Pegi's suspect designation was problematic, as the police never probed Pegi as a witness of a potential suspect before. Additionally, the West Java Regional Police had been unable to produce two substantial evidence against Pegi.
Judge Eman also declared Pegi’s inclusion in the police wanted list as invalid for the same abovementioned reasons.
The police also failed to bring two substantial pieces of evidence against Pegi as they only said to have acquired two pieces of evidence and brought one expert witness. "There was no sufficient evidence during the trial,” Judge Eman said on Monday, July 8.
Judge Eman then ordered the West Java Regional Police to release Pegi and restore his reputation.
West Java Regional Police arrested Pegi Setiawan on May 21, 2024. At that time, Pegi was accused of being one of the three fugitives in the murder case of Vina and Eky. The three are Dani, Andi, and Pegi or Perong.
After Pegi's arrest, the police then declared that there was only one fugitive in this murder case. Police have previously arrested and jailed seven people in this case.
The search for a fugitive was carried out after the murder case was made into a movie recently. Based on Tempo's findings, there were several irregularities in the investigation of this case. Among them were changes in post-mortem evidence and the absence of stab wounds on both Vina and Eky as claimed by the police.
Pegi's attorney, Muchtar Effendi, previously said his client would be free, as the police were unable to confirm whether Pegi Setiawan was the same Pegi on the police’s most wanted list.
"In essence, the West Java Regional Police cannot prove that Pegi Perong is Pegi Setiawan," Muchtar said last Friday.
