TEMPO.CO, Jakarta - President Joko Widodo or Jokowi hoped companies would not use maternity leave as a consideration while recruiting female workers.
"We hope the companies wouldn’t do that,” said Jokowi on Monday, July 8, 2024. "We hope that all the babies are born healthy, so I believe paid maternity leave to prepare for birth and taking care of the baby is humane.” Indonesia recently passed Law Number 4 of 2024 on the Welfare of Mothers and Children during the First Thousand Days of Life Phase, commonly known as the KIA Law. The regulation would allow female workers six months of maternity leave. Jokowi inked the regulation on July 2, 2024.
The maternity leave regulation provides that working women are allowed leave for three months with a maximum extension for another three months, accounting for a six-month maternity leave, given special conditions. The conditions include health problems or complications during or after childbirth, as well as miscarriages. The law also applies if the newborn child experiences health problems or complications.
General Chairperson of the Federation of United Indonesian Workers Unions (FSBPI) Jumisih believes that the maternity leave regulation has the potential for discrimination against married women.
According to Jumisih, companies will opt for employing single women. "In fact, these are efforts to systematically eliminate the working relationship (with married female workers),” she said, Wednesday, June 5, 2024.
Nowadays, many women work in informal sectors with minimal to no legal protection. "Informal workers are not protected by law, it’s been this way for years with no resolve from the government. But the government makes a new regulation instead,” she said.
